Dear Colleagues:
Do any of you have any recollection of ever having read (or written)
something like the following in relation to the special damage
requirement in the tort of public nuisance:
The House of Lords has twice required damage that was
virtually unique to the plaintiff (citing Ricket and
Oglivy).
I thought that the quote had come from Fleming but I cannot seem to
find it there and my searches in other sources have thus far turned
up nothing.
Any assistance is much appreciated. Please feel free to contact me
